Can I add an occasional pilot or obtain coverage for an additional family member under the Silver Wings Plan or an additional pilot under the Gold Wings Plan? SILVER WINGS PLAN: You may not add an “Occasional Pilot” if you are the owner of the aircraft. If another pilot wants to fly your aircraft he/she must purchase their own Silver Wings policy. Similarly, a co-owner of your aircraft cannot be added as an occasional pilot, he/she must purchase his/her own policy. An “Additional Family Member” is automatically covered at no additional premium provided the policyholder has a Canadian Owners and Pilots Association (COPA) family membership and the additional family member you wish to add is a pilot and lives in the same residence as the policyholder. The legal liability coverage for the additional family member applies in the same manner (except passenger legal liability coverage does not apply to student pilots) as it does for the policyholder. GOLD WINGS PLAN: A completed Pilot Report is required for each additional pilot. Once the Pilot Report is received it will be submitted to your insurer for approval (coverage is not automatic). Can the corporation in which my aircraft is registered as owner be covered for liabilty under the COPA Silver Wings Plan? The corporation in which the aircraft is registered may be covered provided you have an interest of 50 percent or more in the corporation. It should be noted that it must be a Canadian corportion. If I take instruction on my own aircraft is my flying instructor covered for his/her legal liability? SILVER WINGS PLAN: While you or a relative of yours who is a resident in your household are using your own or a privately owned aircraft, not owned by the instructor or examiner, registered with Transport Canada as a Canadian registered aircraft, to undergo instruction or flight examination, the policy will cover a flying instructor or flight examiner, who is deemed not to be a passenger, while providing you with flying instruction or flight examination other than on:
i. a helicopter, balloon, hang glider, paraglider, airship, hovercraft, unmanned air vehicle, very light jet (VLJ); or ii. commercially registered aircraft, unless the aircraft used is rented or borrowed for private business and pleasure purposes only,
and only if they are properly certificated and qualified to provide the flying instruction or flight examination and such instruction or flight examination is performed strictly in accordance with all applicable Transport Canada Canadian Aviation Regulations (CARs). The insurance, however, does not apply to any liability the flying instructor or flight examiner may have for bodily injury to you or a relative of yours while providing you or a relative of yours with flying instruction or flight examination. GOLD WINGS PLAN: An instructor or flight examiner is automatically covered provided he/she is providing instruction or flight examination to any of the pilots already named on the policy. Can I purchase liability coverage for a hangar which I privately own or space in a hangar which I rent or lease from someone else? You can purchase the Premises Legal Liability Inclusion Endorsement (in respect of hangars located in Canada only) for a flat additional premium of $175 for a limit of liability of $1,000,000 any one occurrence, or for a flat additional premium of $275 for a limit of liability of $2,000,000 any one occurrence. Damage to third party aircraft is limited to $250,000 any one occurrence. Upon specific request, an airport authority or municipality may be added as an additional insured. Back
What is U.S. Terrorism Risk Insurance Act of 2002 as amended ("TRIA") Endorsement coverage? The COPA Program for both the Silver Wings and Gold Wings Plans does not provide coverage for acts of terrorism. However, with respect to the United States only, the Government of the United States by virtue of the "Terrorism Risk Insurance Act of 2002 as amended ("TRIA") requires that your insurer must offer you the right to purchase terrorism coverage for losses arising out of acts of terrorism, as defined in Section 102 (1) of the Act, as amended. Coverage applies only to an “Act of Terrorism” occurring out of exposures within the United States. The coverage is optional. In the Silver Wings and Gold Wings application form there is a section which you must complete as to whether you accept or decline the coverage. Under the Silver Wings Plan if you elect to take the coverage, the premium charge is an additional 100 percent of the total aircraft liability charge made for your basic liability insurance. For example, if you elected as your basic liability coverage, a $3,000,000 limit including three passenger seats under the “Jan, Feb, or Mar” heading for Coverage “C”, Combined Single Limit Bodily Injury (Including Passengers) and Property Damage Legal Liability, your basic premium is $1,085. To this, you must add an additional premium charge of $1,085 for the TRIA coverage. Hence your total liability premium under the policy would amount to $2,170. Under the Gold Wings Plan, if you elect to take the coverage, the premium charge is also an additional 100 percent of the total aircraft liability charge made for your basic liability insurance. Back
