Coverage Restrictions

Does each aircraft co-owner require a separate policy?

With respect to co-ownership of aircraft: 

SILVER WINGS PLAN:

As the legal liability insurance coverage under the Silver Wings Plan follows the pilot (and not the aircraft) and allows that pilot to fly other non-owned aircraft, it is necessary for each co-owner to purchase his/her own policy.  

With respect to Coverage “D” Aircraft Hull “All Risks” Ground (Not-In-Motion), it is only necessary for one co-owner to purchase this coverage under his/her policy. The policy will include the name of the other co-owners as a loss payee, so that in the event of a claim their interests will be protected (i.e. their names will be included on any claims cheque issued).

GOLD WINGS PLAN:

It is only necessary for one policy to be purchased in the name of the co-owners.

Are there any territorial restrictions as to where I can fly?

Both the Silver Wings Plan and the Gold Wings Plan apply to claims arising from occurrences which take place during the policy period, but only if the claims arise from occurrences in Canada, the Continental United States, Alaska, the French Islands of St. Pierre and Miquelon, the Bahamas Islands, or the islands of the Caribbean, or while en route between these places. A coverage extension to include additional geographical locations will be considered by the insurer, for an additional premium charge, upon submission of full details. 

Note that Coverage under the Marsh Canada Aviation Insurance Program for claims resulting from the use of aircraft in the Republic of Mexico, or its airspace, is limited to amounts in excess of other insurance you have purchased from an insurance company licensed under the laws of Mexico. For flights in Mexico, therefore, you must purchase additional insurance from an insurer licensed in Mexico, in order for the excess protection afforded by the Marsh Canada Aviation Insuarnce Program to be available.

Am I covered for formation flying, flying in an exhibition, air display, or air show?

Formation flying is covered but it does not include formation flying involving any aerobatic manoeuvre. 

The Marsh Canada Aviation Insurance Program excludes any flying in connection with any flying exhibition, air display, or air show other than:

A. Flying in an air show under Transport Canada Special Flight Operations Certificate – Special Event provided that the operations certificate limitations are complied with and no aerobatics are performed; and

B. Flying in a ceremonial fly-past, such as Remembrance Day ceremonies or similar event, where no Transport Canada Special Flight Operations Certificate – Special Aviation Event is in effect, provided flight is at a minimum of 1,000 feet above ground level and no aerobatics are performed. 

NOTE: Under both the Silver Wings Plan and the Gold Wings Plan, a coverage extension for Formation Flying Legal Liability (in respect of F.A.S.T. or SWIFT Compliant Training Program only) is available.

F.A.S.T. is an acronym for Formation and Safety Team. F.A.S.T. Intercontinental is an organization that has taken on the responsibility of making formation flying safer in the warbird flying community.

SWIFT is an aircraft type. The Swift Formation Committee Safety and Training Program is designed to encourage safety, standardization, and proficiency in Swift aircraft formation flying.

This coverage is available if you have completed a F.A.S.T. or SWIFT training program and require coverage for an aerobatic flight consisting solely of "trail and rejoin" manoeuvres flown as part of a F.A.S.T. or SWIFT compliant training program or aerobatic formation flight practice. Third party bodily injury (excluding passengers) and property damage legal liability coverage is available for an additional premium. The maximum limit of liability available is $1,000,000 per occurrence. To obtain coverage, full details of the aerobatic flight must be submitted to the insurer for approval and determination of the additional premium charge.

Am I covered for aerobatics?

Recreational aerobatics only are covered in the basic policies of both the Silver Wings and Gold Wings Plans. This means aerobatics for private and pleasure use only. It excludes any type of air show or competition participation. Under both the Silver Wings Plan and the Gold Wings Plan, a coverage extension for competition aerobatics in Canada will be considered by the insurer, for an additional premium charge, upon submission of full details. This coverage extension is subject to a maximum liability limit of $1,000,000 bodily injury (excluding passengers) and property damage legal liability per occurrence only to third parties. The coverage extension does not cover physical loss or damage to the hull of your aircraft.

Can an aircraft which is registered in another country, be covered under the Marsh Canada Aviation Insurance Program (e.g. a USA “N” registered aircraft)?

Foreign registered aircraft cannot be covered under the Marsh Canada Aviation Insurance Program. The only exception is if you purchase a foreign registered aircraft and need to ferry it to Canada while it is still bearing a foreign registration. In this case, you must provide full details to Marsh Canada Limited so that we may submit your request to the insurer for consideration.

For coverage to apply, you must:

  • Reserve your Transport Canada registration in advance of the ferry flight; and
  • Provide full details of the ferry flight to Marsh Canada Limited prior to the flight.

Can a pilot who is not the holder of a Canadian Pilot Licence or Pilot Permit be covered under the Marsh Canada Aviation Insurance Program?

To be covered under the Marsh Canada Aviation Insuarnce Program, a pilot must be a holder of a Canadian Pilot Licence or Pilot Permit.

With respect to legal liability insurance, can I insure less than the number of passenger seats for which the aircraft is certified?

You must insure the number of passenger seats (excluding the pilot seat) for which the aircraft is certified for any aircraft you fly, whether you own, lease, rent, or borrow that aircraft. Failure to do so may void your insurance coverage.

If you wish to insure less than the number of passenger seats (excluding the pilot seat) for which the aircraft is certified for any aircraft you fly, whether you own, lease, rent, or borrow that aircraft you must physically remove from the aircraft the seats you do not wish to insure. In addition, you must advise Marsh Canada Limited accordingly so that your policy may be endorsed with a Seating Capacity Endorsement.

NOTE: If the number of passengers carried on board any aircraft you fly, whether you own, lease, rent, or borrow that aircraft, exceeds the number of passenger seats (excluding the pilot seat) insured, the coverage in respect of Passenger Liability is voided for ALL passengers on board the aircraft.
